Licensed Application End User License Agreement

LICENSED APPLICATION END USER LICENSE AGREEMENT FOR BIPASS

This Licensed Application End User License Agreement (“Agreement”) is between you (“End User” or “you”) and Bipass (“Licensor”, “we”, “our”, or “us”), the provider of the Licensed Application, which is made available through the App Store (the “App”). This Agreement governs your use of the App and is binding upon your acceptance of this Agreement.

By downloading, installing, or using the App, you agree to be bound by this Agreement and the additional terms and conditions specified in our Privacy Policy and Terms of Service. If you do not agree with this Agreement, you may not use the App.

1. Scope of License

Licensor grants you a non-exclusive, non-transferable, limited license to download, install, and use the App on any Apple-branded product that you own or control and as permitted by Apple’s Usage Rules. You may not:

  • Distribute or make the App available over a network where it could be used by multiple devices at the same time.

  • Transfer, sublicense, or redistribute the App, except as provided herein.

  • Sell, rent, lease, or loan the App to any third party.

  • Copy, reverse engineer, disassemble, attempt to derive the source code, modify, or create derivative works of the App, except as allowed by applicable law.

 

2. Consent to Use of Data

You agree that the Licensor may collect and use technical data and related information, including but not limited to technical information about your device, system, and application software, peripherals, and any other related technologies. This data may be used to provide you with updates, product support, or services related to the App. The Licensor may use this information in a form that does not personally identify you to improve its products or services.

 

3. Termination

This Agreement will remain in effect until terminated by either you or Licensor. Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

 

4. External Services

The App may contain links to external services or third-party websites. These are provided for your convenience, and you access them at your own risk. Licensor is not responsible for the content, accuracy, or availability of any third-party services or websites, and makes no representations or warranties about them. You agree not to use these services in a way that violates the terms of this Agreement.

 

5. No Warranty

You expressly acknowledge and agree that your use of the App is at your own risk. The App is provided “as is” without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. Licensor does not warrant that the App will meet your requirements or that its operation will be uninterrupted or error-free.

 

6. Limitation of Liability

To the fullest extent permitted by law, Licensor shall not be liable for any damages arising out of or related to your use or inability to use the App, including incidental, indirect, special, or consequential damages, even if Licensor has been advised of the possibility of such damages. In no event shall Licensor’s total liability exceed the amount paid by you for the App.

 

7. Export Restrictions

You may not export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. You represent and warrant that you are not located in any embargoed country and are not on any U.S. government list of prohibited or restricted parties.

 

8. Governing Law

This Agreement will be governed by the laws of the State of California, excluding its conflicts of law provisions. You agree to submit to the personal jurisdiction of the courts located in Santa Clara County, California, for any disputes arising from this Agreement. If you are outside the United States, your use of the App shall be governed by the laws of your jurisdiction.

 

9. Miscellaneous

  • Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in effect.

  • Amendments: Licensor reserves the right to update or modify this Agreement at any time. Any changes will be effective upon posting the updated Agreement within the App. Continued use of the App after such changes constitutes acceptance of the revised terms.

 

10. Links to Privacy Policy and Terms of Service

By using this App, you acknowledge that you have read and understood our Privacy Policy and Terms of Service, and agree to be bound by their terms.
